- Receive Notice of agency action (or DDD waiver-service notice / MCO adverse benefit determination)
- (Managed care) file MCO internal appeal within 60 days (within 10 days to continue benefits) and receive Notice of Resolution
- Request Medicaid Fair Hearing in writing to DMAHS: general/DDD within 20 days of the notice; managed care within 120 days of the Notice of Resolution; within 10 days to continue benefits
- DMAHS transmits to OAL; hearing before Administrative Law Judge; Initial Decision within 21 days of hearing
- DMAHS Final Agency Decision (45 days); appeal to NJ Superior Court, Appellate Division within 45 days
