§ 01 — Definition

An HCBS waiver is a Medicaid program that allows states to provide long-term care services in homes and communities instead of institutions. Authorized under Section 1915(c) of the Social Security Act, these waivers 'waive' certain Medicaid rules — most importantly, they allow states to target services to specific populations and geographic areas, and to cap enrollment. HCBS waivers fund services like personal care, respite, habilitation, behavioral support, supported employment, environmental modifications, assistive technology, and family training. Each state designs its own waivers with different names, eligibility criteria, service menus, and waitlists. As of 2026, there are over 300 active HCBS waivers nationwide. Waivers are the primary mechanism for funding community-based disability services in America.
